Terms and Conditions for Cashback Program

Definitions

For the purposes of these Cashback Terms, the following expressions shall have the meanings set out below:

• “Cashback” means a promotional credit, bonus or reward issued by SEAGM for use only within the Platform, subject to these Cashback Terms.
• “Eligible Product” means any product, service or item designated by SEAGM as eligible for Cashback from time to time.
• “Platform” means the SEAGM website, mobile application and any related online marketplace, system or service operated by SEAGM.
• “SEAGM Terms and Conditions” means the prevailing terms and conditions governing the use of the Platform.
• “User”, “you” or “your” means the person or entity accessing, purchasing from or otherwise using the Platform.

General Application and Acceptance

By participating in, claiming, retaining or using Cashback, you acknowledge that you have read, understood and agreed to be bound by these Cashback Terms. If you do not agree, you must not participate in or use any Cashback benefit.

These Cashback Terms apply in addition to all other applicable SEAGM rules, including without limitation rules relating to account registration, purchases, promotions, refunds, disputes, chargebacks, fraud prevention and platform integrity.

Nature of Cashback

Cashback is a promotional benefit made available by SEAGM at its sole discretion and does not constitute cash, legal tender, electronic money, stored value, a deposit, a security, a debt owed by SEAGM or any other form of regulated financial product.

• Cashback has no independent monetary value outside the Platform and is redeemable only as a discount against future eligible purchases, if and when permitted by SEAGM.
• Cashback does not earn interest, dividends or other returns.
• Cashback is non-transferable, non-assignable, non-exchangeable and may not be sold, gifted, pledged, traded or otherwise dealt with except as expressly permitted by SEAGM in writing.
• Any reference to an amount of Cashback is a promotional reference only and does not create any cash entitlement.

Eligibility, Accrual and Credit

Cashback may be offered only on selected Eligible Products, campaigns, regions, account categories or customer segments, as determined by SEAGM in its sole discretion and without obligation to provide similar benefits to any other user.

• Eligible Products and the applicable Cashback amount, rate, cap or other conditions will ordinarily be displayed on the relevant product page, campaign page or other designated area of the Platform.
• SEAGM may, at any time and without prior notice, amend, suspend, withdraw or limit Cashback eligibility, including by product, category, region, account status, device, payment method, order value or promotional period.
• Cashback will only accrue on a valid completed purchase of an Eligible Product, and only where the transaction is not cancelled, refunded, reversed, disputed, charged back or otherwise invalidated.
• Unless otherwise stated, Cashback will be credited to the User’s account within six (6) hours after successful completion of the qualifying transaction, subject always to system verification, risk checks and any internal review by SEAGM.
• If Cashback is not credited within the expected timeframe, the User must contact customer support within a reasonable time and provide any information reasonably requested by SEAGM for verification.

Redemption and Use of Cashback

Cashback may be used only by a registered account holder with an active and good-standing account on the Platform.

• Cashback may be redeemed only as a partial discount against eligible future purchases on the Platform and may not be used to pay processing fees, taxes, service charges or any other excluded amount unless SEAGM expressly permits otherwise.
• Cashback may be applied only up to the maximum permitted amount for the relevant order, as determined by SEAGM from time to time. Cashback may not be used to reduce any order value below zero.
• Any remaining balance of the purchase price must be settled using one or more approved payment methods available on the Platform. SEAGM may impose minimum redemption thresholds, maximum redemption caps, category restrictions, jurisdictional restrictions, daily/monthly/annual limits or other operational controls.
• Unless expressly permitted by SEAGM, Cashback may not be combined with other discounts, coupons, vouchers, referral benefits, promotional credits or special pricing offers.
• Where more than one promotion or benefit may apply to a single transaction, SEAGM shall determine in its sole discretion which promotion, benefit or discount applies, and such decision shall be final.

Eligible Payment Methods

Cashback shall only be earned on transactions completed using payment methods expressly designated by SEAGM as eligible for the Cashback program.

Unless otherwise stated by SEAGM, eligible payment methods are limited to:

• FPX / Online Banking; and
• approved e-wallet payment methods made available on the Platform.

For the avoidance of doubt, Cashback shall not apply to transactions completed using:

• credit cards;
• debit cards; or
• any other payment methods not expressly designated as eligible by SEAGM.

SEAGM reserves the right, at its sole discretion and without prior notice, to:

• add, remove, suspend, or modify eligible payment methods;
• impose additional restrictions or conditions on eligibility; and
• determine whether a transaction qualifies for Cashback.

SEAGM’s determination regarding payment method eligibility shall be final and binding.

Expiry and Forfeiture

Unless a different validity period is stated in the relevant promotion terms, Cashback shall expire twenty-four (24) months after the date it is credited or earned.

• Expired Cashback shall automatically lapse and be permanently forfeited without notice, compensation, refund or reinstatement.
• SEAGM may shorten or extend the validity period of Cashback for a particular promotion, product category, or jurisdiction by publishing the relevant promotional terms on the Platform.
• It is the User’s responsibility to monitor the balance and expiry date of any Cashback credited to the account.

Refunds, Returns, Chargebacks and Reversals

Where an underlying qualifying transaction is cancelled, refunded, partially refunded, returned, reversed, disputed or subject to a chargeback, SEAGM may, without prior notice, reverse, deduct or adjust any Cashback previously credited in relation to that transaction.

• If the Cashback has already been redeemed, SEAGM may deduct an equivalent amount from the User’s account balance, impose a debit balance, reverse related benefits, or take any other reasonable action necessary to restore the account to the position that would have applied had the Cashback not been granted.
• SEAGM may defer crediting Cashback until expiry of any applicable return, cancellation or chargeback review period.
• A User remains liable for any negative balance, adjustment or reversal arising from the cancellation, refund or chargeback of a qualifying transaction.

Fraud, Abuse, Technical Error and Enforcement Rights

SEAGM reserves the right to withhold, delay, refuse, cancel, reclaim or reverse any Cashback, or to suspend or terminate any account, where SEAGM reasonably suspects or determines, in its sole discretion, that a User has engaged in fraud, abuse, manipulation, misuse, automated or artificial transactions, breach of these Cashback Terms, or any conduct that undermines the integrity of the Platform or the Cashback program.

• Examples of prohibited conduct include, without limitation, self-dealing, multiple account creation, collusive transactions, chargeback abuse, false claims, use of stolen payment instruments, exploitation of system errors, use of bots or scripts, or any attempt to circumvent promotional limits.
• Where Cashback has been credited in error, due to system malfunction, clerical mistake, incorrect configuration or any other unintended cause, SEAGM may correct the error and recover the over-credited amount at any time.
• SEAGM’s determination regarding fraud, abuse, error or misuse shall be final and binding, subject only to any mandatory rights that cannot be excluded by law.

Suspension, Modification and Termination

SEAGM may, at any time and without prior notice, amend, suspend, restrict, replace or terminate the Cashback program, in whole or in part, for operational, commercial, compliance, security, legal or other reasons.

• SEAGM shall not be liable for any loss, inconvenience or disappointment arising from any amendment, suspension or termination of the Cashback program.
• If the Cashback program is suspended or terminated, SEAGM may determine how any outstanding Cashback will be treated, including whether it remains valid, expires immediately, or may only be used within a specified transition period.
• Nothing in these Cashback Terms shall be construed as creating any obligation on SEAGM to continue offering Cashback for any minimum period.

Availability, Third-Party Services and Technical Limitations

SEAGM does not warrant that the Cashback program, the Platform or any related services will be uninterrupted, secure, error-free or available at all times.

• SEAGM is not responsible for delays, failures or interruptions caused by network conditions, system maintenance, telecommunications failures, force majeure events, third-party service providers or other circumstances beyond its reasonable control.
• Where Cashback relates to products, services or merchants supplied by third parties, SEAGM makes no representation or warranty concerning such third-party goods or services and is not responsible for any third-party acts or omissions.
• Any technical malfunction, display error, calculation error or unauthorized access affecting Cashback may be corrected by SEAGM without liability.

Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Cashback program and all related benefits are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, statutory or otherwise.

• SEAGM disclaims all implied warranties and conditions, including warranties of merchantability, satisfactory quality, fitness for a particular purpose, non-infringement and accuracy.
• SEAGM does not guarantee that Cashback will meet any User’s expectations or that any errors will be corrected immediately, or at all.
• Any material obtained or action taken in connection with the Cashback program is undertaken at the User’s own discretion and risk.

Limitation of Liability

To the fullest extent permitted by law, SEAGM shall not be liable for any indirect, incidental, special, consequential or punitive losses, or for any loss of profits, revenue, goodwill, opportunity, data or anticipated savings arising out of or in connection with the Cashback program.

• SEAGM’s aggregate liability arising from or in connection with any Cashback claim shall be limited to the Cashback amount actually credited in relation to the relevant transaction, unless otherwise required by applicable law.
• Nothing in these Cashback Terms excludes or limits liability that cannot lawfully be excluded under applicable law.

Amendments

SEAGM may revise these Cashback Terms at any time by posting an updated version on the Platform. The updated Cashback Terms will take effect from the date of publication unless a later effective date is stated.

• Continued participation in or use of Cashback after publication of any updated terms constitutes acceptance of those updated terms.
• It is the User’s responsibility to review these Cashback Terms regularly.
